HERE IS A SUMMARISED UPDATE OF AN EYE WITNESS REPORT ON THE PROCCEDINGS AT THE ENUGU TRIBUNAL TODAY: 19/07/2023

- The Ist Respondent, Enugu Inec through her lawyer, H.I.OKOLI ESQ informed the Court that Inec has reviewed her case and has chosen not to field any witness. In law, uncontroverted evidence is presumed to be true.
- The 2nd Respondent, Peter N. Mba fielded two witnesses viz: Dr. Festus Uzo and another witness who claimed to have come from the DSS office. It’s important to state for the records that Dr. Festus Uzo came to represent Mba and that all the evidence he tendered in Court was information he gathered from Mba. Of course, we know the legal implications of hear-say evidence. Also, under cross examination, Dr. Uzo admitted that there was over voting in some of the areas particularly Nkanu East.
- The 2nd witness who said he came from the office of the DSS testified that he investigated Mba’s NYSC Discharge Certificate and found same to be authentic. Funny enough, under cross examination, it was discovered that the investigation report he came to tender at the Tribunal was written on a plain sheet. Such report should be contained in the official letterhead of the DSS. Again, the report does not carry any stamp of the DSS neither was it signed and dated. Legally speaking, such evidence is nothing but a tissue paper without any evidential value. Also, the witness did not affirm to the Court that he had the authority of DSS Boss to come and testify.
- Beyond the foregoing, it’s pertinent to point out for the records that DSS, assuming without conceding, does not have the jurisdictional competence to investigate matters of this nature. The constitutional role of the DSS is narrowly restricted to the detection and prevention of crimes and threats against internal security.
- On a final note, if I may ask; where did the DSS carry out their investigation? Was it at the NYSC office who already disclaimed the result?
There are too many things to interrogate but, let’s stop here for now.

Hired DSS officer, Yahaya Isah Muhammad, flopps in Court, admits his deposition was not authorized or signed by the DG, DSS.
The deposition was neither stamped nor written in DSS letterhead paper.
Admits the services not aware that Mbah was Chief of Staff as at the time he should be serving as a corp member in Lagos.
